New Seller Disclosure Scheme in Queensland

 

From 1 August 2025, the way property is sold in Queensland will change. A new statutory seller disclosure regime will be introduced under the Property Law Act 2023 (Qld). This transformative change mandates sellers of freehold land - including residential, commercial, and vacant properties - to proactively disclose critical property information before buyers sign a contract.

 

Sellers are required to complete and sign a Form 2 Seller Disclosure Statement and supply prescribed certificates. This move reverses the long-held "buyer beware" stance, placing the responsibility on sellers to deliver critical facts upfront. It's a shift towards greater transparency and consistency that aligns QLD with NSW and VIC regimes.

 

What you must include in the disclosure statement:

Part 1: Seller and property details

Part 2: Title details, encumbrances and residential tenancy or rooming accommodation agreement

Part 3: Land use, planning and environment

Part 4: Buildings and structures

 

Sellers:

  • Plan early: engage a solicitor or speak to one of our agents about your Form 2 preparation
  • Budget properly: expect additional costs for searches, certificates, and professional fees
  • Ensure accuracy: incomplete, inaccurate or outdated info could lead to termination or legal claims

 

Buyers:

  • Use disclosures to inform your purchase, but don’t rely exclusively on them
  • Continue due diligence: inspections, flood planning reports, pest checks, etc.
